It was April 1, so there was slight hope it was a joke. Alas, it was not. Our Parliament, in its last sitting at the Palace before it rose for a month-long Easter recess, approved the so-called Gender Identity Bill.

It was a unanimous vote, although two-thirds of the Opposition were not there. Maybe they were ashamed, and rightfully so. They should be.

NY Times: Surgery and Sterilization Scrapped in Malta's Benchmark LGBTI Law

http://www.nytimes.com/reuters/2015/04/01/world/europe/01reuters-gay-rights-malta.html?_r=1
APRIL 1, 2015 By REUTERS

LONDON (Thomson Reuters Foundation) - Transgender people in Malta will no longer need to have surgery, sterilization and a diagnosis of mental illness to legally change gender under a law passed on Wednesday, which rights groups hailed as a new benchmark for LGBTI rights in Europe.

The majority of countries in Europe require transgender people to undergo a series of medical procedures, be diagnosed with a mental disorder and get divorced if married in order to have their desired gender legally recognized by the government.

The Gender Identity, Gender Expression and Sex Characteristics Act makes Malta only the second European nation, after Denmark, to allow transgender people to change their legal gender without any medical or state intervention.

Malta Today: Gender identity bill passes into law

A Bill aimed at protecting the rights of trans, genderqueer and intersex people to their self-determined identity has passed into law

A Bill aimed at protecting the rights of trans, gender queer and intersex people to their self-determined identity has been enacted into law, with both sides of the House in Parliament voting in favour of it.

The law has removed the need to undergo sex reassignment surgery before official documents – such as an ID card or passport – are changed to reflect the holder’s gender identity. It will give people the choice of not declaring their sex or gender identity on identification documents through the introduction of an ‘X’ marker.

It has rendered gender reassignment surgery a valid reason for sick leave, hate crimes will be expanded to include hate crimes against gender-queer and intersex people, and trans-people will be allowed to change their identity while they are married.

Times: Gender Identity Bill approved unanimously

The Gender Identity Bill was unanimously adopted by the House of Representatives this evening.

Both government and opposition voted for the bill when it was moved for third reading by Equal Opportunities Minister Helena Dalli.

When she introduced the bill early in February, Ms Dalli explained how one would henceforth not require a medical intervention to be recognised in the gender with which one identified. It shall be everyone’s right to request the Director of the Public Registry to change the recorded gender and, or, first name, to reflect that person’s self-determined gender identity.

The director will not require evidence other than a notarial deed including a clear and unequivocal declaration by the applicant that one’s gender identity does not correspond to the assigned sex in the act of birth.

The law will also provide parents with the possibility to postpone the entry of a gender marker on their children’s birth certificate until the child is 14 years old.

Although the third reading of a bill is usually routine, all government MPs were present for the vote except ministers Anton Refalo (sick) and Evarist Bartolo who is abroad. Many opposition MPs were absent including Opposition leader Simon Busuttil, who had however earlier tweeted that the Opposition was backing the Bill.

This was brought up during a seminar organised by the Malta Gay Rights Movement (MGRM), entitled ‘Inclusion of Trans and Intersex Persons through Legislation and Policy’ and held at the Victoria Hotel in Sliema on Thursday.

Malta Today: ‘Gender identity law to break down walls of discrimination’ - Helena Dalli

Equal Opportunities Minister Helena Dalli

A law aimed at protecting the rights of trans, gender queer and intersex people to their self-determined identity will help “break down the walls of discrimination and inequality”, Civil Liberties Helena Dalli said.

“This law isn’t about the rights of trans-people, intersex people and gender queer people but about human rights,” Dalli said during a second reading of the Bill in Parliament. “We will not be giving these people special rights but equal rights. We want to ensure that everyone has the same rights and access to the same opportunities.”

Although ‘male’ and ‘female’ will remain the only sexes recognised by the laws of Malta, the government is set to allow individuals to choose not to declare their sex or gender identity on identification documents through the introduction of an ‘X’ marker.

The decision comes in wake of the Gender Identity Bill tabled in parliament and a consultation process that followed during which an internal discussion took place on how the current ‘male’ and ‘female’ binary possibilities could be addressed on identification documents.

A public consultation on a new Gender Identity Bill was issued by the government this evening as the Bill was given a first reading in Parliament.

Public Dialogue Minister Helena Dalli explained that the government was proposing to regulate the procedure for change of legal gender for minors and adults alike.

At present, she explained, changes to documents on gender could only be made after gender reassignment surgery. However, the law would henceforth provide that, even without surgery, it shall be the right of everyone to request the Director of Public Registry to change the recorded gender and, or first name in order to reflect that person’s self-determined gender identity.

Waqt il-Konvenzjoni tal-Partit Nazzjonalista li kompliet dalgħodu, Alex Mangion, persuna transgender, wera t-tama li fl-Att dwar il-Ġeneru (Gender Identity Bill) li se jkun qed jitressaq għall-vot fil-Parlament, il-PN ma jerġax jastjeni, bħalma għamel fil-vot dwar l-Unjoni Ċivili. “Jien tad-demm u l-laħam. Meta tiġi l-Gender Identity Bill, astensjoni oħra mhix għażla,” sostna Mangion.

Huwa spjega kemm kien ibbuljat fl-iskola u kemm kellu problemi kull darba li seta' kellu bżonn affarijiet mill-aktar bażiċi. Kompla jgħid li bl-Att dwar il-Ġeneru “ħajjitna tinbidel għax ma jkollniex għalfejn nistaħbew. Jien ma tlabtx biex insir hekk; in-natura għamltini hekk. Kunu konxji minnha u nitlobkom li tifmhuna biex ngħixu ħajja aħjar. Ninsab ċert li se tgħinu biex ikollna drittijiet aħjar,” temm jgħid Mangion għall-aprovazzjoni ta’ dawk preżenti.

Malta has become the first European state to have gender identity in its constitution following the proposed amendment that was approved yesterday evening in parliament.

The news has reached foreign shores and Transgender Europe (TGEU) was among the first NGOs to laud Malta for including gender identity as a protected ground in its highest legal text.
